Productivity Commission should avoid premature recommendations

Berry Simons has lodged a submission on the Productivity Commission’s draft Better Urban Planning report, which makes recommendations to the Government about changes required to the planning regime to improve urban planning.

Poor outcomes from implementation, not the RMA - Report

The partners of Berry Simons agree with a key conclusion of the Environmental Defence Society’s report “Evaluating the Environmental Outcomes of the RMA” that “the environmental outcomes of the RMA have not met expectations, largely as a result of poor implementation”, rather than poor delivery by the RMA itself.

AUP appeals lodged – legal effect and weighting

About 100 appeals have been lodged. Where an AUP provision is not the subject of any appeals, the AUP is deemed to be approved - the ODP can be disregarded. Where any AUP provisions that apply to a site are subject to appeal, both the ODP and the Decisions Version of the AUP have legal effect and questions of the relative weighting of the plans will arise.
